Attorneys Fees - You can't collect them unless you have a contract clause or a statute. - Skelton & Cooley Law Office

If you are drafting an agreement, make sure you have a clause which says that the prevailing party in any dispute gets their attorneys fees, because unless you have a statute that allows automatic collection of fees, you will usually pay your own attorneys fees in any Montana case where there is no such clause.
